Terms of Service
Please read these terms before using our website or placing an order with DearLoria.
Last updated: October 18, 2026
OVERVIEW
Welcome to DearLoria.
This website, dearloria.com, is operated by LUMINFEST INC, trading as DearLoria. “We,” “us,” and “our” refer to DearLoria. Our store is hosted on Shopify, which provides the ecommerce platform through which we sell our products and services.
Using our website or purchasing from us means you agree to these Terms and the referenced policies. These Terms apply to all users of our “Service.” If you disagree, do not use it.
Our Privacy Policy, Shipping Policy, and Refund Policy provide further details. These Terms also apply to new features and tools.
Nothing in these Terms excludes or limits rights or protections that applicable consumer law does not allow us to exclude or limit.
SECTION 1
Online store terms
By using the Service, you confirm that you have reached the age of majority where you live. If you allow a minor dependent to use this site, you confirm that you are an adult and have given your consent.
You may not use our products or the Service for an illegal or unauthorized purpose, including a use that infringes copyright or other applicable laws. You must not transmit viruses, worms, or other destructive code.
A breach of these Terms may result in the immediate termination of your access to the Service, subject to applicable law.
SECTION 2
General conditions
We reserve the right to refuse service where permitted by law. You must not reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, access to it, or the contact channels through which it is provided without our express written permission.
Content may be transmitted across different networks and adapted to the technical requirements of connected networks or devices. Our handling of personal information, including order uploads, is described in our Privacy Policy.
The headings in these Terms are for convenience and do not change their meaning.
SECTION 3
Accuracy, completeness and timeliness of information
General website information may not always be accurate, complete, or current. Do not rely on it alone when a decision requires more specific or up-to-date information.
Historical information is for reference only. We may change website content without updating every item unless required by law. Please check for relevant updates.
This section does not limit our responsibilities for product descriptions, information we are required to provide, or your mandatory consumer rights.
SECTION 4
Modifications to the service and prices
Product prices may change without notice. We may also modify, suspend, or discontinue all or part of the Service.
Where legally permitted, we are not responsible for losses arising solely from these changes. Our obligations concerning existing orders, refunds, and mandatory rights remain unaffected.
SECTION 5
Products or services (if applicable)
Some products or services are available only through our website and may be offered in limited quantities. Returns and exchanges are governed by our Refund Policy and applicable law.
We make reasonable efforts to display product images and colors accurately. The colors you see may vary depending on your screen and its settings. Except for our express commitments and obligations under applicable law, we do not guarantee that a product, service, or item of information will meet every personal expectation.
We may limit sales by person, region, or jurisdiction on a case-by-case basis, limit quantities, change product descriptions or prices, or discontinue products where permitted by law. An offer is void where prohibited.
Returns and exchanges: You may request a return or exchange within 30 days of receiving your order, subject to the eligibility requirements in our Refund Policy. Contact us for approval and return instructions before sending an item back.
Discounted items: We do not accept refunds for personal reasons on discounted items. Defective, damaged, or incorrectly shipped discounted items may still qualify for a refund or exchange.
Paid-order cancellations: A cancellation may be requested within 24 hours after payment is verified, provided production or shipping has not started. We cannot cancel after that period or once production or shipping has begun. For a cancellation unrelated to product quality or an error on our part, a $15 processing fee is deducted from the refund.
Processing time: The entire review and refund-processing period is 7–10 business days after we receive your returned item or cancellation request. Any approved refund is issued within that period to the original payment method. Your payment provider may need additional time to post it.
These points summarize our Refund Policy. Please read that policy for the full eligibility requirements, return-shipping responsibilities, and procedures, and our Shipping Policy for delivery information. Nothing in this summary limits your mandatory consumer rights.
SECTION 6
Accuracy of billing and account information
We may refuse an order or limit or cancel quantities purchased per person, household, or order where permitted by law. This may include orders using the same customer account, payment card, billing address, or shipping address. We may also limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.
If we change or cancel an order, we may attempt to contact you using the email address, billing address, or telephone number you provided. Any payment due to be refunded will be handled in accordance with our Refund Policy and applicable law.
You agree to provide current, complete, and accurate purchase and account information and to update it promptly when necessary, including your email address and payment details, so that we can complete transactions and contact you.
SECTION 7
Optional tools
We may give you access to optional tools provided by third parties that we do not control or monitor. To the extent permitted by law, these tools are provided “as is” and “as available,” without endorsement or warranties from us.
Use of an optional third-party tool is at your discretion. Please read and accept the provider’s terms before using it. To the extent permitted by law, we are not liable for losses arising from your independent use of those tools.
New tools, features, and services are also subject to these Terms.
SECTION 8
Third-party links
Our Service may include third-party content or links to websites that are not affiliated with us. We do not control those websites and are not responsible for checking their content or accuracy.
Please review a third party’s policies and practices before purchasing from or interacting with it. Questions or claims about an independent third party’s products or services should be directed to that party.
To the extent permitted by law, we are not responsible for harm or losses arising from independent transactions on third-party websites. This does not remove our responsibilities for your DearLoria order or any responsibility that cannot lawfully be excluded.
SECTION 9
User comments, feedback and other submissions
Public comments and feedback. If you submit reviews, comments, suggestions, or other material for public posting, you permit us to edit, copy, publish, distribute, translate, and otherwise use that material in any medium without compensation. We are not required to publish or respond to it or treat material submitted for public posting as confidential.
Order photos and custom-design files are excluded from that permission. It does not cover photos or files uploaded for an order, personalization details, private support messages, or other personal information.
You retain your rights in the content you upload for a customized product. You grant DearLoria only the permission needed to review, reproduce, adapt, and use that content for custom production, order fulfillment, and after-sales support. Where necessary, we may provide it to service providers assisting with those purposes. We do not use these order photos or custom-design files for advertising, public display, or unrelated purposes. This does not prevent retention or disclosure required by law or necessary to resolve a dispute about your order, as described in our Privacy Policy.
You must have the rights or permission needed for the material you submit. Your submissions must not infringe copyright, trademarks, privacy, or other rights, or contain unlawful, defamatory, abusive, obscene, or malicious content. Do not impersonate someone else, use a misleading email address, or misrepresent a submission’s origin.
We may monitor, edit, or remove public content that we consider unlawful, offensive, threatening, defamatory, obscene, or otherwise inconsistent with these Terms or another person’s rights, but we are not required to monitor every submission. You are responsible for your submissions and their accuracy. Any limitation of our responsibility for third-party comments applies only to the extent permitted by law.
SECTION 10
Personal information
Personal information submitted through the store is handled as described in our Privacy Policy. That policy explains the information we collect, how it is used and shared, and how to contact us about privacy.
Order uploads remain subject to the limited purposes in Section 9.
SECTION 11
Errors, inaccuracies and omissions
Occasionally, our website or Service may contain errors or omissions relating to product descriptions, prices, promotions, offers, shipping charges, delivery estimates, or availability.
We may correct errors, update information, or cancel an affected order where permitted by law, including after an order has been submitted. If an order is canceled, any refund due will be handled under our Refund Policy and applicable law.
Unless legally required, we need not update every item of information. An update date does not mean all website content was updated then.
SECTION 12
Prohibited uses
You must not use the website or its content to:
- Carry out or encourage unlawful acts, or violate applicable laws, regulations, or rules.
- Infringe our intellectual property rights or anyone else’s rights.
- Harass, abuse, threaten, harm, defame, intimidate, or discriminate against another person, including on grounds of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
- Submit false or misleading information, impersonate others, or use the Service for obscene or unlawful purposes.
- Upload viruses or other malicious code, disrupt the Service or another website, or interfere with or bypass security features.
- Improperly collect or track another person’s personal information, or carry out spam, phishing, pharming, pretexting, unauthorized crawling, scraping, or similar misuse.
We may terminate access to the Service for a prohibited use, subject to applicable law.
SECTION 13
Disclaimer of warranties; limitation of liability
We do not guarantee that access to the Service will always be uninterrupted, timely, secure, or free from errors, or that every result obtained through it will be accurate or reliable. We may suspend or discontinue access as described in these Terms.
Except for our express commitments and rights or warranties required by law, the Service and products offered through it are provided “as is” and “as available.” To the extent legally permitted, we disclaim other express or implied warranties or conditions, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Subject to the limitations below and only to the extent permitted by law, DearLoria, LUMINFEST INC, and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors are not liable for injury, loss, claims, or direct, indirect, incidental, punitive, special, or consequential damages arising from use of the Service or products obtained through it. This includes lost profits, revenue, savings, data, replacement costs, or similar losses, whether a claim is based on contract, tort, negligence, strict liability, or another basis, even where the possibility of such losses has been raised.
These exclusions do not override our express obligations under the Refund Policy or exclude, restrict, or modify mandatory consumer rights or any liability that cannot lawfully be excluded. Where a jurisdiction does not allow a particular exclusion or limitation, it applies only to the maximum extent permitted there. Your statutory rights concerning defective, misdescribed, or incorrectly supplied goods remain unaffected.
SECTION 14
Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless DearLoria, LUMINFEST INC, and our parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees against a third-party claim or demand, including reasonable legal fees, arising from your breach of these Terms or incorporated policies, or your violation of a law or another person’s rights.
This section does not impose an obligation that applicable consumer law does not permit.
SECTION 15
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, it will apply only to the extent permitted by law. The unenforceable part will be treated as removed, without affecting the validity and enforceability of the remaining provisions.
SECTION 16
Termination
These Terms remain effective until terminated by you or us. You may stop using the Service or notify us that you no longer wish to use it.
If we determine or reasonably suspect that you have failed to comply with these Terms, we may terminate the agreement or deny access to all or part of the Service without notice, where permitted by law. You remain responsible for amounts properly due up to the termination date.
Existing rights, obligations, and liabilities survive where applicable, including refund obligations and mandatory consumer rights.
SECTION 17
Entire agreement
If we do not exercise or enforce a right under these Terms, that does not mean we waive it.
These Terms and the incorporated policies and operating rules form our agreement about the Service. Subject to applicable law, they replace earlier agreements, communications, proposals, and Terms on the same subject.
An ambiguity will not be interpreted against a party solely because it drafted the Terms, except where applicable law requires otherwise.
SECTION 18
Governing law
These Terms and any separate agreements through which we provide the Service are governed by and construed in accordance with the laws of the United Kingdom.
This choice of law does not deprive you of mandatory consumer protections that apply under the law of your place of residence.
SECTION 19
Changes to terms of service
The current version of these Terms is available on this page. We may update, change, or replace provisions by posting the revised Terms on our website and updating the date shown above.
Please check for updates. Continued use after changes take effect means acceptance, where legally permitted. Changes do not remove rights already arising from an existing order.
